Terms and Conditions

Deposit:
A non-refundable deposit equal to 10% of the total job cost is required to secure a spot on the calendar, payable through the payment portal on the next page with NO FEES.

 

Full Payment:
Full payment is due upon completion of the work.

 

Payment Preferences:
For the remainder of the payment, Cash or Check is highly preferred. We may accept credit cards with a 3% fee.

 

Additional Work:
Any additional work requested while performing the work, other than what was originally stated, will incur additional costs and may not be able to be performed on the same day due to scheduling.

 

Customer Responsibilities:
The customer is acting in the position of the property owner or authorized manager (Decision maker) and tree owner/manager, or has received permission from the owner to allow specified work. In the event of any tree being mistakenly identified as to ownership, the customer agrees to hold harmless and indemnify JP Tree Care for any resulting damages or costs.

 

Safety Precautions:
The property owner agrees not to enter the work zone for safety reasons during the duration of the job.

Dog/Pet Poop:
Yes, just like no one likes stepping on pet poop, we don't either. It makes the job harder and less enjoyable. Therefore if you have pets, please have the surrounding work area cleared of any landmines. The team will forever appreciate your gesture. If there is excessive dog waste, we will have to reschedule the date until the area is confirmed to be cleaned, or we may continue with a $200 fee that will be shared with the crew as a tip.

Liability:
JP Tree Care, its affiliates, helpers, contractors, or owners will not be held responsible or liable for damages or repairs to the driveway, turf, underground sprinklers, drain lines, invisible fences, or underground cables/utilities (unless the system(s) are adequately and accurately mapped by the authorized party and a copy is presented before the work is performed), occurring from equipment access, including but not limited to a bucket truck, wood chipper, pickup truck, etc., or any tree operation such as removal or pruning.

Nature of Work:
We take great care to minimize the impact of our operations on your property during tree work. However, it's important to note that:

Adjacent trees or plants near the work zone or the tree being serviced may incur potential damage as a result of the operation.
Some visible markings may remain after the project is completed. These can include sawdust, small tree debris, tire markings on grass if accessing the tree by truck or using small equipment, as well as indentations in the yard from our operations. Please understand that these are natural consequences of the tree care process and help us keep our prices more affordable. JP Tree Care or anyone affiliated will not be held liable for any damage to other plants or trees in the surrounding work area. If yard markings are a concern, please let us know beforehand and we may have them repaired by a local landscaper at an additional cost. Nonetheless, we are committed to completing our work with the utmost care and respect for your property. If you have any concerns or questions regarding this matter, please don't hesitate to discuss them with us.


Plant Health Care:
Plant health care is performed in good faith to attempt to address plant problems and is not warranted. While we strive to provide the best care possible, it's important to note that the outcomes of plant health care services can be influenced by various factors, including the unpredictable nature of the environment.

Tree Root Collar Excavation:
Customer understands we will be excavating soil with a high power air tool (Airspade) around the base of the tree, resulting in turf surrounding the tree to be disturbed. It is highly recommended that soil surrounding tree is watered a day before work takes place to reduce dust. After work takes place, the homeowner is to water the tree at least once a week for 3 weeks (unless we get rainfall) to provide immediate moisture.

Tree Cabling and Bracing:
Tree cabling/bracing is performed to provide structural support and help prevent the risk of tree failure by reinforcing weak or damaged branches. Yearly inspections are required. The homeowner is responsible for contacting JP Tree Care to schedule a yearly inspection. The customer is aware of the risks presented and understands that cabling/bracing is NOT a guarantee that the tree or limb will not fail. The customer agrees to indemnify and hold harmless JP Tree Care, its affiliates, helpers, contractors, or owners from liability or responsibility for partial or whole tree failures, and for any damages or injuries that may occur, and understands, accepts, and agrees to the risk.

Stump Grinding:
The stump, along with any adjacent surface roots, will be ground down to a depth of approximately 6 to 8 inches below the ground level. Any pavers or movable objects in close proximity to the stump will be relocated if easily movable; if not, the stump will be ground as closely as possible. There is a possibility that a portion of the stump or its roots might remain after the grinding process if we face an immovable object.

Tree Risk Assessments/Health Evaluations:
Tree risk assessments/health evaluations are conducted solely for the purpose of evaluating potential risks associated with trees. These assessments do not guarantee or promise that a tree will remain free from failure. The evaluation is based on the available information and conditions at the time of assessment. Trees are living organisms subject to various dynamic factors that can change over time, and unforeseen circumstances can impact their stability. Therefore, the results of a tree risk assessment should not be interpreted as an absolute assurance of a tree's future behavior. JP Tree Care and its representatives are not liable for any tree-related incidents, damages, or injuries that may occur despite the assessment results. The tree manager/owner is ultimately responsible for the tree and safety.

Cancellation:
The client understands and agrees that the deposit is non-refundable, even if the client cancels the service. The provider reserves the right to cancel the service and refund the deposit if the provider is unable to fulfill the services for any reason.

Refunds:
There are no refunds after services are performed, unless we really messed up and can't make it right.

By paying the deposit, the client acknowledges that they have read and understood this agreement, and agrees to be bound by its terms.
